What is ISP License?

ISP or internet service providers need to obtain a specific license in order to start the operations. This license is categorised in the 3 types depending upon the regions in which the internet service can be provided.

These types are:

  • ISP Category A License: This is for ISPs that want to provide internet service all over the country.
  • Category B License: This is for ISPs that want to provide internet services in 20 territorial regions.
  • Category C License: This is for ISPs that seek to provide internet service in any secondary switching area of

However, there is no category specific license, there is only a single unified license through which it can be stated in which category, and you are looking to provide internet services.

Who can apply for ISP License?

To apply an ISP license in India, you need to register a company under the Companies Act, 2013. The Company can be OPC, Private or Public Limited.


Documents Required for ISP License?

PAN Card

PAN Card of shareholders and Directors. Foreign nationals must provide a valid passport.

Identity Proof

Aadhar card and Voter ID/ Passport/ Driving License of Shareholders and Directors.

Director’s Address Proof

Latest Telephone Bill /Electricity Bill/ Bank Account Statement of Shareholders and Directors.

Photograph

Latest Passport size photograph of Shareholders and Directors.

Business Address Proof

What is ISP License

Initially Government of India, Department of Telecommunications (DOT) started to provide Internet services or all telecom related services in India by Videsh Sanchar Nigam Limited. On later stage as demands got increased, Government of India has opened up the doors for Private Sectors as well. Now Private Sector Company can also apply for Internet Service Provider (ISP) Licence. This license is commonly known as Unified License (UL). Private Sector Companies can apply for ISP license for different areas under Unified License. It is mandatory for Company to have Unified License for providing ISP services for a certain area. One Company can acquire only one Unified License (UL), but can also apply for more than one ISP Authorization for other areas. Although validity of all Authorization shall be till the validity of Unified License (UL)

When should I apply for a Unified (ISP) license?

If you have no experience in the ISP business & limited capital to invest, we recommend you to opt for an existing ISP’s franchise. If you have some experience in the ISP business, you can consider opting for an ISP license. Having an ISP license makes it easier to buy bandwidth at cheaper rates. However, this only makes sense if you have an existing subscriber base.

What is the validity Unfied (ISP) License?

ISP license agreement is valid for a period of 20 years.

Which service area authorization should I opt for?

Under unified license, the license holder can apply for authorization of different services & service areas. Hence, it must be understood that one has to apply for an ISP Authorization for a service area under the Unified License. One company can hold only one Unified License, but can apply for service area authorization of multiple services and/or service areas. Currently in India, there are 3 categories of Unified (ISP) license service area authorization:

  • Category ‘A’ – National Area
  • Category ‘B’ – Telecom Circle/Metro Area
  • Category ‘C’ – Secondary Switching Area
How much time does this application take?

The complete process from filing your application to getting the Unified (ISP) license takes about 3-5 months. Once you file your application, the DoT will issue you a ‘Letter of intent’ within 2 months. After this, it takes about 1-3 months to furnish all bank guarantees and additional information required by the DoT.

What are the annual/quarterly compliance and costs for ISP License holder?

Once you are a licensed ISP, you need to submit a quarterly report of your customer base, billing details, upload & download details. Also, you are required to pay 8% of your Gross Revenue to DoT.
